- The student between the ages of 6 and 18 must attend school and district-required tutorial sessions unless the student is other wise legally exempted or excused. School employees must investigate and report violations of the state compulsory attendance law. A student absent without permission from school, from any class, or from required tutorials will be considered truant and subject to disciplinary action, which may include court action. (EC 25.094 Failure to attend school – (a) An individual commits an offense if the individual: (1) is required to attend school under Section 25.085; and (2) fails to attend school on 10 or more days or parts of days within a six-month period in the same school year or on three or more days or parts of days within a four-week period.)
- The law gives schools the right to file a complaint in court. Fines for unexcused absences range up to $500+ and court costs.
- A student who voluntarily remains enrolled after the age of 18 is required to attend school. If the enrollment is revoked, the student will be treated as an unauthorized person and may be arrested for trespassing if he/she comes onto school property. (EC 25.093 Parent contributing to nonattendance – (a) If a warning is issued as required by Section 25.095 (a) the parent with criminal negligence fails to require the child to attend school as required by law, and the child has absences for the amount of time specified under Section 25.094, the parent commits an offense.
